Potentially significant move by EP to vote to push ahead with including shipping within Emission Trading Scheme. Not everyone is happy though, as is to be expected. A brief thread on some key aspects... 1/
The EP remains critical of the pace of progress being made by @IMOHQ. EP finds it untenable for maritime transport to be the only sector outside EU emission reduction measures. And the #greendeal makes provision to address GHGs from maritime sector. 2/
To that effect, three major measures are advanced:
1. Extend ETS
2. Restrict access of especially polluting ships to EU ports
3. Force greater use of shore-side electricity 3/

Also, the legislative proposal aims to:
- establish and Ocean Fund
- create a labelling system based on environmental criteria of ships.
Specifically, the proposal aims to include "core elements of the IMO Initial Strategy in Union law" (recital 8) but go beyond that by... 4/
Creating a target for shipping companies to reduce GHG (not just C02) emissions by 40% by 2030.
Shipping industry would be included in ETS from Jan 2022.
Companies would be obliged to use shoreside electricity and MS would be obliged to meet targets on providing access to it 5/
The geographical scope of application is interesting as it will apply to ships sailing within the EU but also arriving at or departing from an EU port.
As to personal scope, the party responsible for the commercial operation of the ship is relevant, not necessarily shipowner 6/
The suggested way to determine this is also quite novel, referring as it does to whoever is paying for the fuel.
This is in line with rapporteur @JuttaPaulusRLP aim of explicitly incorporating the polluter pays principle. 7/
Finally (for this quick run through), the COM will continue to monitor the effectiveness of IMO measures. So further "unilateral" (or at least outside the global legal framework) EU measures cannot be excluded. Of course, questions as to the efficacy of this have been raised. 8/
The EU has been effective in the past in nudging/cajoling/forcing the intl community and IMO into making greater efforts to address environmental issues related to shipping. Remains to be seen what the final outcome will be here 9/9 end. #lawofthesea #shipping #ETS
