FCA ruling - lots of people asking about what happens next and we will host a legal webinar next week on it. Quick overview - impact on policy holders will be individual depending on precise policy wording and reasoning of court
court has ordered insurers to contact all policyholders whose claims will be impacted by the decision (and we presume this means those previously rejected for being unresponsive but should now be covered when guidance applies) within 7 days. May still need individual court case
There is still possibility of appeal and parties will be debating grounds for expedited ruling - an appeal in some form seems likely as there is quite broad interpretation particularly around disease cover. In short, yesterday is not the end of the process
Court interpreted outbreak and vicinity quite widely - arguing that when Covid hit it was clear there would be an impact on insurer and insured. Narrower ruling on access clauses but in both cases the specific and precise wording on policy is still@important - no blanket answer
