3-minutes away.
Just in- Special Prosecutor Fred Franklin just walked in to city hall - told me he won’t say anything until he gets a call from the Clerk’s office. Thought it would be in 5-10 minutes. @WOWT6News
I’m assuming the Clerk is verifying/certifying the Grand Jury decision which would make it official.
In order for any indictment, Grand Jury vote does not need to be unanimous. 12-of-16 jurors have to agree. The special prosecutor served as a guide. There’s no defense or judge involved. @WOWT6News
Just in: Special Prosecutor taking now. He’s sharing the process with us now.
Breaking: @OmahaPolice detectives interviewed 60 people and a number of video clips shared with grand jury of that night in Rhe Old Market.
Fred Franklin says Indictment
Breaking: manslaughter, use of a firearm in commission of a felony, attempted first degree assault & terroristic threats indictments against Hive bar owner Jake Gardner. @WOWT6News
Grand Jury hands up indictments on bar owner Jake Gardner. Special prosecutor says much of the evidence connected to manslaughter case came from Gardner himself - cellphone records, Facebook messages, other video from inside his business. @WOWT6News
Special prosecutor says that nothing in this decision should be viewed as a knock on County Attorney Don Kleine — saying Don does his job with the highest of integrity. Kleine has determined it a case of self-defense initially.
Special prosecutor says this decision is not a time for celebration — these are simply charges and Jake Gardner is presumed innocent.
Special prosecutor says protests certainly have a place but shouldn’t be the only tool in the toolbox. He’s suggesting now isn’t the time to be destroying stuff in reaction. Said economic boycotts, voting, uniting behind a business or cause. Those are options.
