PL source tells me it is NOT true all #NUFC listed directors passed O&D Test. “No determinations were made prior to the consortium’s withdrawal.” If directors had been cleared, with Al Rumayyan being most contentious from those listed, #NUFC would know. Easy for them to confirm.
There is a difference between no grounds for rejection but an ongoing process v official clearance (or rejection) which comes at end. PL adamant the consortium pulled out before any concrete clearance, for both specific individuals and broader bid, was given.
What is clear is no individual director was rejected either. The club and the director in question would have been notified. So a big part of the forthcoming legal case will be 1) can the Test even be construed as rejected to begin with or is ‘blame’ on consortium...
By ‘blame’ I mean the consortium chose to withdraw despite being told the Test was not complete. Of course, they counter by saying they had no other choice because the PL brought proceedings to a gridlock. PL deny this. It again all comes down to what info was requested/provided.
2) If it’s deemed Test was effectively (not formally) rejected then it gets interesting. At this point, with no director cleared or rejected, a reason must be determined. Lack of info, willingness, transparency or intentional delays... all possible depending on side you believe.
