Alex Salmond's lawyers also say the Lord Advocate should be asked to approve disclosure of various documents from the *criminal* case - helpfully he's up before the committee shortly...
I would be reasonably surprised if the committee actually agreed to pay for Alex Salmond to go to the Court of Session over these documents, incidentally - but the threat alone is another way of putting pressure on the government to hand them over voluntarily
This was John Swinney's reasoning why govt shouldn't waive privilege and reveal legal advice about the judicial review - lawyers need to feel able to offer "free and frank" views and publishing them could "undermine this ability on future occasions"
