The Centers for Disease Control and Prevention (“CDC”) has issued a temporary nationwide halt on residential evictions for nonpayment of rent for qualifying renters, effective September 4 through December 31, 2020.
In order to be covered by the moratorium, a tenant must provide to the landlord a declaration under penalty of perjury that the tenant: (1) expects to earn no more than $99,000 in calendar year 2020 (or $198,000 if filing a joint tax return);
(2) is unable to pay full rent due to an economic hardship; (3) has used best efforts to obtain all available government housing assistance; (4) is making best efforts to make timely partial payments; and
(5) would likely be forced into homelessness or a close quarters shared living setting if evicted.
