Any underage sex of any kind is still illegal under SB 145. So if two teenagers have sex, that is still illegal even when there is nothing predatory going on and the person over 18 would be convicted, that has not changed at all.
Currently, judges are allowed to use their discretion in cases of close ages (10 years, the actual age difference it SHOULD be can be debated) for vaginal sex whether or not the adult should be registered as an offender because this shit is messy.
What SB 145 does is extend that allowance to oral and anal sex as by only allowing it for vaginal sex it inadvertently results in putting more LGBTQ+ people on lists who need not be than hetero people
and again I get it's weird subject that is much easier to just point and say "look that terrible perverts californians are? but that's not what is happening or what this is about
and to be clear this bill doesn't apply to any cases under 14. that is still automatic as frankly it should
and again the actual age difference that will invoke this is fair to argue on but the point is that the law as it existed be it intentional or not inequitably affected a portion of our society unfairly and this aims to correct that inequity
rape and assault are still just as illegal and still an automatic sex offender registration
