Additionally, at least 39 minors apprehended by US border officials with their parents or other adult family members were expelled last month after being held in hotel rooms, per the data.
These are migrant children and families who were expelled under the legal authorities of a CDC order the Trump admin. says supersedes immigration, asylum and anti-trafficking laws that allow border crossers, particularly minors, to seek US asylum or other relief from deportation.
In addition to those reported as having been expelled, the data shows 20 unaccompanied migrant children and 5 minors in families were set to be expelled at the end of July while in ICE custody (in hotels).

It is unclear if they were ultimately expelled.
Also in July — 9 unaccompanied children initially set to be expelled were removed from hotels and transferred to the US refugee agency, which Congress tasked with their care.

37 minors in families set to be expelled were also allowed to undergo regular immigration proceedings.
It’s important to note that this data does not include the number of migrant families and children expelled by land to Mexico—instead of their home countries via ICE flights—without being held in hotels.

The Flores case lawyers are also reporting inconsistencies in ICE’s data.
