The 1960 Civil Rights Act requires that officials preserve election records for 22 months. It was enacted after officials destroyed records re: disenfranchisement of black voters.

Digital images of the ballots in the 2018 midterm elections in Florida (won by Republicans) would have helped when Broward county "lost" over 2K paper ballots "somewhere in the building," but officials didn't know to preserve them & had destroyed them. 2/
As a result of Audit USA's lawsuit and successful opposition to Florida officials' motion to dismiss, the officials have agreed in a stipulation to preserve the digital ballot images in the event of a presidential recount. 3/
