What exactly has the ACLU spent its money on?
❌denied our federal right to unionize
❌challenged half the workers’ right to unionize by calling them managers
❌refused to bargain with us over write-ups

Ogletree’s first attack was denying our federal right to unionize. They claimed that since the ACLU of Kansas only operates in Kansas, we as workers weren’t protected under the national labor relations act in unionizing and filed a jurisdictional challenge.
Because of the public pressure and solidarity you offered, the ACLU dropped this challenge and fired Ogletree Deakins, but they replaced them with another anti-union lawyer, Jeffrey Hirsch from Boston. Hirsch helped bust @SEIU1199_NE Health Care Workers union amongst others.
Hirsch continued with the other half of Ogletree’s strategy- incorrectly classifying half our workers as part of management, a common union busting tactic to chip away at solidarity and drag out NLRB hearings.
Hirsch and the ACLU’s denial of these workers required us to fight for it in an NLRB hearing. For a month we fought this tactic with internal advocacy but still prepared our case. They dropped the challenge the day before the hearing.
When we won union recognition- they started writing up workers. Discipline is a mandatory subject of bargaining, which management refused to do. We had to file an unfair labor practice against them to protect our workers and others from such a blatant violation of labor law.
The ACLU has been given every opportunity to do right by us and by the labor law they supposedly champion, and every time they have challenged our right to unionize with every legal front they can muster. It’s been an expensive fight. Please donate if you can and share our story!
