So I've seen a lot of people going after Kamala Harris for being anti trans and I really didn't know much about this so I did some reading up on her record as Attorney General of California in regards to LGBT issues and I have some thoughts (thread).
At first glance her record on LGBT issues seemed immaculate. All except really only one (major) issue. That was that her office appealed the decision of a lower court that required the California Department of Corrections & Rehabilitation to provide and cover the costs of...
...gender reassignment surgery. Her office was trying to reverse the ruling which at first glance seemed very bad. But the more I looked into the more complicated it got.
Let's start with the fact Harris was the Attorney General for California. The constitution of California states that the AG acts as the chief counsel in state litigation. Her constitutional responsibility that was placed on her as an elected official required her office to act..
..as the legal representation for the state. And furthermore to argue on their behalf regardless of how she felt. Now just because it's law clearly doesn't make it right and under no circumstance was what her office was arguing for right but it was the job of the AG office..
If she refused there could have been a number of other legal and constitutional issues. I also think it's important to metion that the AG office in California is huge and takes on a lot of cases and multiple things I have read state that initially Harris wasn't involved much...
... in the cases but as they worked their way through litigation she became more involved and actually helped them come to a conclusion that lead to positive changes in the policy of how California prisons treated transgender inmates.
At the end of the day her office was wrong but calling her transphobic based on this issue and ignoring all the positives she has done (for LGBT people, I'm not going into any of the other issues with her record as AG on this thread) I think is wrong and extreme.
