Just in case I am unable to complete my BPTC Ethics exam on Friday (like many of my fellow students have been unable to), I would like this thread to stand as evidence that I would have at least received a competent. /1
CD2 - duty to act in best interests of each client. Having paid a lovely £525 fee to the BSB at the start of the year, I would like to think that they would have fearlessly represented my interests (rC15.1). Not sure they have even listened. /2
CD3 - duty to act with honesty and integrity. Passing the buck to PearsonVUE and those sitting the exams rather than accepting personal responsibility for their own work (rC20) seems to be in breach of this principle. /3
CD5 - must not behave in a way likely to diminish the trust and confidence the public places in you or the profession. Forcing people to urinate into a bottle or dehydrate during a heatwave would tend to diminish public trust and confidence in any profession. /4
CD6 - must keep the affairs of each client confidential. Slightly more tenuous, but the extent of data collection and requiring highly intrusive facial recognition software would potentially raise concerns here. /5
CD7 - must provide a competent standard of work and service. Given the contents of Legal Twitter today, not sure this needs any elaboration. Despite blaming PearsonVue, you are responsible for work you outsource (rC86, gC65-66) /6
CD8 - must not discriminate unlawfully against any person. As @blwstndsbrd have long stated, these arrangements hurt those with disabilities, caring commitments and medical needs particularly hard. Seems fairly discriminatory to me. /7
CD9 - must be open and co-operative with your regulators. No communications forthcoming and no opportunity to even raise these issues with the BSB. /8
These exams are disgraceful and, despite concerns raised months ago, there was no backup plan for if everything goes wrong. I am moving onto another course and, hopefully, full-time employment. Can't wait to do 4 more months of memorising the Handbook alongside that. /9
