If one was deemed legally Black they could be enslaved until 1865. They could be subject to miscegenation laws until 1967. They were subject to de jure segregation and voter suppression until 1965 (defacto continues). They were subject to restrictive covenants until 1948 /2

If one was deemed legally mixed race they could be subject to slavery until 1865 (unless they proved their mother was "white"). They were subject to miscegenation laws until 1967 & often legally couldn't marry anyone depending on the state if they didn't fit in a racial category
Racial categories today are based on discrimination and statistical study. Therefore they are determined by how one identifies oneself (for statistical study) and how others identify them (discrimination). Even affirmative action is only an issue for correction discrimination /5
Bernstein's legal racial analysis is bizarre and destructive and completely ahistorical. Kamala Devi Harris identifies as Indian and Black. She is treated as if she is Black. She is the first Black woman on a major party ticket. Her "legal" race is irrelevant #BidenHarris2020

Additionally an obsession with legal racial categorization only serves discrimination and Nazism. Should we all wear labels with our official "legal" racial status?
