The White House announced 5 district court nominees on this Wednesday afternoon, including 1 for Florida, 1 for Kentucky, and 3 for New York (!).
For the Middle District of Florida's sole vacancy, the White House is putting forward Kathryn Kimball Mizelle, an associate at Jones Day, and former clerk to Justice Thomas and Judges Greg Katsas and Bill Pryor.
Mizelle appears to be the new youngest Trump judicial nominee, as judging by the fact she graduated from college in 2009, she's probably only around 33 years old (!).
Mizelle introduced Justice Thomas and Judge Katsas at the Florida Federalist Society conference this past winter.
Fun fact: she's married to Chad Mizelle, the acting general counsel of the Department of Homeland Security.
If I had to guess, Mizelle is almost certainly an administration selection.
Next, the WH has decided to nominate a former clerk of Ruth Bader Ginsburg (!) to serve on the Western District of Kentucky in Louisville. Squire Patton Boggs partner Benjamin Beaton would fill Judge Justin Walker's district court seat (which opens up on 9/1), if confirmed.
Mitch McConnell isn't returning blue slips on liberal nominees all of a sudden. Beaton is probably the only card-carrying FedSoc member to have clerked for Justice Ginsburg.
Finally, the White House put forward 3 picks for New York district court seats, which means all 7 vacancies in the state have nominees now. I'd assume the NY senators have signed off on them, but who knows. 🤷‍♂️
Hector Gonzalez and David Woll would serve on the Eastern District of New York, and Ryan McAllister would serve on the Northern District of New York, if confirmed.
McAllister is the second Trump nominee to this Northern District seat; the first, Thomas Marcelle, withdrew after Senator Kirsten Gillibrand declined to return a blue slip on his nomination. https://twitter.com/fedjudges/status/1167580321602310147
If I had to guess, Woll and McAllister are administration picks, and Gonzalez is the Schumer-Gillibrand selection.
One addendum: I'll have to eat crow on my prediction from earlier that Kentucky Solicitor General Chad Meredith would be nominated to Judge Walker's district court seat. Seems the Bevin pardon scandal held him up. https://twitter.com/fedjudges/status/1268668825987399682 https://www.courier-journal.com/story/news/politics/2020/07/22/gov-beshear-asks-court-compel-pardon-documents-ag-staffer/5477515002/
That would be similar to what happened to Indiana SG Tom Fisher's potential nomination to the 7th Circuit, which fell through after Vice President Pence feared his confirmation process would reveal damaging information from his tenure as IN governor. https://www.politico.com/story/2019/07/12/mike-pence-kanne-judge-trump-1411915
All in all, a very interesting group of judicial nominees today. Mizelle and Beaton will likely be confirmed by the end of the year. The fate of the 3 New York nominees depends on what happens with their blue slips. This close to the election, I'd be surprised if they proceed.
