Under Ontario law, employees are entitled to time-and-a-half pay after a 44-hour work week, but supervisors are not — so long as they only do non-managerial tasks on an “exceptional basis.” This is the exemption the class action says Starbucks relies on to exclude store managers
But according to @JMandryk @GPLLP , if you& #39;ve ever grabbed a cup of coffee from Starbucks there& #39;s a good chance you were served by a store manager. They& #39;re required to work at least 3 days a week on the shop floor serving, cleaning etc
Store manager Trevor Hopman sometimes worked 18 hour days at peak busy hours and covering for sick or late baristas, the suit says. But unlike other Starbucks employees, he was told he wasn& #39;t eligible to overtime for it.
The suit claims workers like Trevor are actually "working managers" who *are* entitled to overtime under the law.
