In Zepeda, Gov is saying they want Eric Bonnar to testify in evidentiary hearing but want to postpone until after Aug. 25 to allow him to testify. Judge Chhabria agrees Bonnar is an appropriate witness but questions whether he would be the only witness.

Gov says if court wants ICE to re-test every week, doesn't seem to be a good use of test for folks who have COVID or are in quarantine. Chhabria reminds them that testing is relevant to know when someone can come out of quarantine.

@justicenlaughs tells Chhabria that TRO says defendants should administer rapid test results but there's no clear statement about what is rapid test. If test doesn't produce results, its worthless. Reality at MV is worst! Test results from Aug. 3-5 as of ystrdy were not returned!

In decl filed 2 hours by ICE Becerra, no suggestion that Dfts plan to do anything to expedite tests!

Numerous instances where we have received info that is critical to this case but ONLY after we notified Dfts.

GEO says 13 detainees at MV have tested positive....their numbers are WRONG!

ICE says that the tests that are outstanding are the ones offered to people in Mesa Verde before the issuance of the TRO.

Chhabria wants to know the bottom line about how soon the tests results will come back! And, of course, ICE doesn't have that information....
