I doubt people concerned about rehabilitative justice and Eisen‘s reformation after “serving time” are actively putting in the work of calling him in and holding him accountable for that rehabilitative work. Why? Because prisons are assumed to have done that work.

But his serving time in prison doesn’t mean that the survivor’s needs are met. It just means that he has paid his dues to the state. The 14-year old victim attempted suicide 2 days after the rape, do people defending him know this?
Really rehabilitative, restorative justice work takes time and involves community, something that prison is the opposite of since it’s about isolating and keeping the person away from community.

Why does it involve community? Because the person who committed harm was one of us.
This means that the community has to reflect on what harmful ideas and behaviours may have enabled the person’s behaviour and commit to changing that. We could talk about rape culture. We could talk about how young girls are sexualised and unprotected, vulnerable to grooming.
But our criminal-legal system is so convenient for escaping this difficult work. Everything is individualised. The person who committed harm supposedly takes on full responsibility for the crime and the community of enablers don’t have to see themselves implicated in the harm.

Like we have to be very clear that this is a case about sexual violence that has a very specific kind of treatment within the legal system and in our society.
Another thing about individualising, carceral punishment is that the “solution” is seen as purely about reforming the perpetrator, and the survivor is not involved.

When justice work does not involve the victim’s needs, that’s when we get this messy self-absorbed discourse.
But in reality if we centre the needs of the victim in justice work, as we should, then our focus cannot be on the perpetrator’s needs only but also on victims. The work is not complete if victims do not feel safe and healed from harm. It’s tied together.
Victims will suffer a long, long time from the trauma they suffered by their violators. This is a violence so many have to bear quietly, every day, without people defending them. They are forced to leave spaces where their violators were, but this isn’t seen as “de-platforming”.
