Last I checked, the Sixth Amendment doesn’t limit a person’s right to a fair trial to victimless crimes. https://twitter.com/timburchett/status/1289404054808875008
Yes. https://twitter.com/adam_canter/status/1289413747509952512?s=21
It’s a shame when a court goes out of its way to explain what it knows will be an unpopular ruling in clear layman’s terms, and media either don’t link to the opinion and/or people ignore the reasoning. So again, thank you @bostonherald.
The crux of the court’s decision is application of Patriarca v. U.S., 402 F.2d 314 (1st Cir. 1969): https://casetext.com/case/patriarca-v-united-states

Relevant portion of that case excerpted here:
It’s relatively straightforward—trial court should’ve done a better job ensuring an impartial jury—but what stands out to me is that in the very article @timburchett QT’d, the author included this:
In conclusion:
1. We have not lost our way. The panel is looking out for the defendant’s constitutional rights, as it should.
2. If you really want this dude to die (arguably you shouldn’t, but that’s neither here nor there) the panel didn’t shut the door on that possibility.
TL;DR reading is rad. https://twitter.com/timburchett/status/1289312649671348224?s=21
Yep. Good thing he’s not off the hook for his crimes. https://twitter.com/anilildarlin/status/1289559404224770048?s=21 https://twitter.com/anilildarlin/status/1289559404224770048
OK? What’s the problem with everyone having an equal right to vote though? That’s a sincere question. Felons already lose their liberty, not sure why they have to lose their right to vote too. cc @G_Padraic https://twitter.com/rocky_top_fever/status/1289406958391394304?s=21 https://twitter.com/rocky_top_fever/status/1289406958391394304
No, everyone is guaranteed the rights secured by the Constitution, regardless of the nature of the crime they’ve been accused of. https://twitter.com/nikki30548687/status/1289558089570689030?s=21 https://twitter.com/nikki30548687/status/1289558089570689030

My thoughts exactly. cc @Rocky_Top_Fever https://twitter.com/g_padraic/status/1289569198566383616?s=21
Yea, constitutional rights are such a hassle and inconvenience. https://twitter.com/jlemremom/status/1289362592213827584?s=21
The panel did its job. Relax. https://twitter.com/tony_tmoney1966/status/1289341299603038209?s=21 https://twitter.com/tony_tmoney1966/status/1289341299603038209
Of course you should still have constitutional rights, and you very well could be sentenced to death. https://twitter.com/nikki30548687/status/1289572561764798465?s=21
Well said. 👊🏻 https://twitter.com/ashton/status/1289443178584535041?s=21
A lot of Americans should really reevaluate the extent to which they understand the Constitution and care about the principles espoused therein before blathering about it. https://twitter.com/popelizbet/status/1289571164600311809?s=21 https://twitter.com/popelizbet/status/1289571164600311809
Well, that’s certainly a unique take, I’ll give you that much. https://twitter.com/sean__reed/status/1289352209390395392?s=21
I wasn’t expecting anyone to suggest we use torture to punish criminals. “Eighth Amendment? What’s that?”
I share your gladness, but my naïveté is all my own, I guess. https://twitter.com/ruleslawstudent/status/1289576740033978369?s=21
Don’t mind me, just going to support abolishment of the death penalty by linking an @acslaw op-ed: https://twitter.com/acslaw/status/1289577181102964737?s=21
Alright, let me see if I understand you correctly: Criminals should lose the right to vote because they lack good judgment, but once they are out of prison, they attain good judgment, so they can vote again. https://twitter.com/rocky_top_fever/status/1289576843348029440?s=21
I see where you’re coming from @Rocky_Top_Fever but that concept of “good/bad judgment” seems arbitrary. Everyone has bad judgment at times. Some people never get convicted. Some that do are wrongly convicted. There are a lot of holes in that theory.
Again, I get the appeal of that argument, but it still seems flimsy to me. Not only does America not prioritize rehabilitation, but the notion that you can lose a right because you might use it in a way that other people won’t like is gross. https://twitter.com/rocky_top_fever/status/1289582524650291206?s=21
Naturally, @G_Padraic sums it up better than I ever could. https://twitter.com/g_padraic/status/1289582415917142019?s=21 https://twitter.com/g_padraic/status/1289582415917142019
