BREAKING: Government launch independent panel to examine reform to judicial review -- the process by which citizens can challenge decision made by government or state bodies. Panel will be chaired by Lord Faulks, a barrister, Tory peer & former justice minister, who chairs IPSO.
The review will look at whether the terms of judicial review should be written into law, whether certain executive decisions should be decided by judges, the grounds & remedies available & any further procedural reforms, such as timings and the appeal process.
It will also examine a range of data and evidence, including relevant caselaw, on the development of judicial review and consider whether reform is justified.
Lord chancellor: JR will always be essential part of our democratic constitution – protecting citizens from an overbearing state. Review will ensure this precious check on gov power is maintained, while making sure process not abused or used to conduct politics by another means.
Government doesn't like losing JR's, esp when judges ruled suspension of parliament unlawful or said Shamima Begum should be return to UK to appeal removal of citizenship. I'm told gov win about 80% of all judicial reviews - yesterday it won over jail terms of terror offenders.
MoJ just sent additional comment from the panel chair, Lord Faulks: “Together we will examine judicial review and the need to strike a balance between the right of citizens to challenge government through the courts and the elected government's right to govern."
