People were denied employment due to their perceived sexuality or transgender status.
Supreme Court firmly rooted their decision in biological distinctions between male and female - in order to determine if they were homosexual or transgender. This is 'extremely promising' - Elizabeth Hungerford.
Now @AudreySuffolk talking about @MForstater case - why did she lose and what are the grounds for appeal?
Certainly unusual to be dissecting a first instance tribunal case in this way - but very obvious that this case is of 'great significance'
NO evidence @MForstater had harassed colleagues - as is commonly reported - but simply that she expressed sympathy with GC feminism. Her contract was therefore not renewed and this was the basis of her claim, founded in sex discrimination and protected class of religion/belief.
There was a preliminary hearing about whether her belief in sex was protected under the Equality Act - has to apply principles in Grainger v Nicholson.

Judge found that her belief in sex could not be protected as incompatible with human dignity.

Thus confirming that the law, can at times, be an arse.

The existence of sex is not a 'belief'.
interesting to note that leading equality law QC has opined that this decision won't survive appeal. have to differentiate between 'belief' and how one will behave in workplace. And did Judge get Article 10 freedom of expression principles correct?

Harry debated 'in probably a slightly robust way'.
The actions of Humberside were held to have breach Harry Miller's Article 10 rights. That decision will be a factor in @MForstater case.
