Want to know why almost no info is being released about Breonna Taylor's death? Let me tell you a story about the time (yesterday) the public info officer for Louisville Metro Police Department made up a section of Open Records Law and then tried to act like it didn't happen 1/9
On July 11th I sent a detailed records request for info relevant to Breonna Taylor's case. On July 15th I got a response asking for clarification on 2 items (out of more than 10). I responded the following day (July 16th), and followed up on Tuesday (July 21st). No response. 2/9
So I wrote back Wednesday (7/22) saying unless they sent me the info requested by the end of the next day I was gonna appeal to the AG for failure to comply w/ the law. 4 hrs later I got a reply saying I was wrong, and they had until the 27th. Notice the bold (emphasis added) 3/9
My first reaction was "damn, sounds official." But then I looked at the law they were citing and realized they... weren't actually citing it. The law very clearly says 10 CALENDAR days. Like, it could not be clearer. Did they just.. make it up? Is this a tactic they use? 4/9
So I replied pointing this out (and using bold, because I am my father's son). I cited the law, I linked to it, and I asked what they were citing (since it clearly wasn't the thing they said they were citing) 5/9
An hour later I got a reply. Suddenly, they're talking about all the work they have, all the work it's gonna take to produce my request, and how it'll be 25 business days until they'll be able to complete it. No mention of the law. Not even a word about what had just happened 6/9
It's almost certainly not true they don't have what I asked for already compiled. It's stuff the FBI would already have asked for. It's also not true they only produce requests in full (I know this, bc I have requests that were produced piecemeal by the same person!) 7/9
If you've made it this far, congratulations. Because there's a kicker. I was accidentally included on an email reply to my original request, where I'm referred to in the 3rd person and they divulge they're sending requests to a group or team for which there's no record online 8/9
And, in case that wasn't enough, the email they sent me where they tried to act like they hadn't just been caught fabricating Open Records Law, it wasn't a reply to me—it was a reply to them forwarding my email to that group. So.. I now have the group's email 😂 9/9
I was warned about LMPD, but this is next level. Anyway, last night I filed another records request for everything (memos, emails, employees, etc) about this group/team they seem to be using to coordinate responses or decide what info they will/won't release. Stay tuned! 10/9
