To those who watched the House proceedings on the ABS-CBN franchise renewal application:

Let us assume that the hearing was not
moro-moro.
proceedings were supposed to determine if ABS-CBN was qualified to have a new franchise to enable it to continue operating. That was the task of the House. What is the principal function of Congress? The answer is clear - to pass laws, to legislate. And who enforces laws passed?
The answer is just as simple - the Executive Branch of the Government.

And who determines if a law passed by Congress and being enforced by the Executive has been violated? Another clear answer - the Judiciary upon proper complaint duly filed before it.
To be continued
What happened during the proceedings in Congress which recently terminated?

It was a hearing on alleged various violations of the franchise previously issued to ABS-CBN.

When Congress passed the franchise years back, that franchise was the law it enacted. It accomplished its
When Congress passed the franchise years back, that franchise was the law it enacted. It accomplished its task when the law was passed.

If that law was violated, it is the Executive that is tasked to investigate and prosecute any violation thereof, and the judiciary to finally
Did the Executive file any such case and did the Judiciary find the network guilty of any such violation?

The answer to both questions is a deafening NO!
This becomes more interesting. In the hearing conducted by Congress, the Congressmen presented alleged violations and after the hearing, they themselves sat in judgment to decide if the violations they accused the network of violating were in fact violated.
And then they decided that the violations were committed, thus the decision to deny the application for renewal.

A classic but despicable situation of the Accuser and the Judge being one and the same. Congress accuses and Congress judges. Due process, Congress style.
Time to abolish the Executive and Judicial branches of government because it now seems they have become irrelevant. Congress can do their work for them.
If it was a hearing to determine if ABS-CBN is qualified to be granted a franchise, what should have been logically the subject of determination are the qualifications of the applicant.

And where can one find the qualifications required?

The answer is again simple - the law.
In the lengthy, redundant hearing, did anybody mention or state clearly the law that provides the qualifications for an applicant for the franchise applied for?

What was the Republic Act number or whatever governing law? And what were the qualifications required by that law?
Could it be that no such law and prescribed qualifications exist?

Instead of citing such a law and the qualifications imposed by that unspecified law, the congressmen concentrated on the alleged violations, which in the first place should have been competently determined by the
Executive and the Judiciary, of a franchise that had already expired.

Of what use did such a hearing accomplish legally and justly?

Congress certainly could not pass any law repealing the grant and revoking the franchise since the franchise has expired, in other words DEAD.
Instead, Congress denied the new franchise applied for without any finding that ABS-CBN does not possess the qualifications imposed by law, as in fact Congress could not even state the applicable law.

So there you are. Was justice dispensed with or was ignorance of the law exposed? 🙏🏻
