I'm using my personal account to post this thread. I do work for D2L, but this response has nothing to do w/my job, so I'll post personally.
I was a D2L customer for 8.5 years and have now worked there for 8.5 years. 17 years of engagement w/D2L in one capacity or another.

I was an educator for 27 years. Now I'm the Teaching & Learning Advocate for D2L.
The misinformation that has been spreading does not seem like something that educators would engage in, so I'm a bit surprised.

1a) The Terms of Service (TOS) snippet that has been shared widely comes from our company website. At the very top of that page ( https://www.d2l.com/legal/terms/ ) it states:

1b) "Please note: If you were given access to the Brightspace platform by your organization, these terms do not apply to your use of Brightspace. You should contact your organization about any applicable term of use that may apply."

1c) In other words, the TOS apply only if you post something on our company website (maybe a blog post about why critical reading skills are critically important). They don't apply to Brightspace in any way. Never have. Saying it does apply doesn't change the fact that it doesn't
2a) D2L is 20 years old. It's currently used by over one thousand organizations. So, if you believe that D2L claims ownership to anything and everything that gets posted in a Brightspace course, then hundreds of thousands of educators have been duped over the past 20 years

2b) Isn't it amazing that not one of those educators has ever complained about D2L stealing their stuff? Not even 1? Does common sense indicate that maybe your accusations just aren't true? Maybe?

3) Some of you seem to have your own agenda, but why? After receiving replies (not just from me) about how your "reading" of the TOS is wrong, you've continued to re-post your misinformation. You're educators, so I think you're smarter than that. There must be another reason

4a) Personally, I find it hilarious that you think the very nice Canadian guy who founded this LMS company 20 years ago is more of an overlord who can't be trusted than the high mucky-mucks at Google.

4b) Seriously? Do a search (maybe use Duck Duck Go instead of Google) and see how many times Google has been involved with data breaches, security flaws, and many other types of problems. Then do the same for D2L. This is not a close call people.

In closing...D2L DOES NOT NOW, nor HAVE THEY EVER, made claims of ownership (or anything similar) to any content that is put into Brightspace for any reason by any customer, and that also applies to students posting their work.
