My brother #JagtarSinghJohal, a Scottish national, travels to India in Oct 2017 to get married, marriage takes place, joyful occasion on the 18th. On 4th Nov 2017 he is out shopping with his wife & cousin, unknown men pull him out of a car & hood him 1/19
bungle him into a van and drive off, leaving his wife and cousin in the middle of a busy road, screaming for help, police complaints made in India to no joy, I am called first thing in the morning and cannot believe what I've been told. I pick up the phone to the @FCO 2/19
as I believed my brother had been kidnapped. The FCO tell me they will inform their colleagues in @UKinIndia to make enquires. As the day develops, family members are told that he has been taken to a police station, upon checking there, he is not there. 3/19
@PunjabPoliceInd advise to go to court in the morning with a lawyer. I find a lawyer in India to attend, my sister in law is then told to attend the police station in the morning, she attends with family to be told he is not there, meanwhile in court the police seek custody 4/19
the judge grants 5 days for interrogation, when any British national is detained in another country, they are required to advise the @FCO they didn't do this, the FCO had no information. I booked an emergency flight to India in the morning. On 7th November my brother is 5/19
pronounced guilty of criminal offences by @capt_amarinder in an open press conference as a result I am forced to leave the country, due to potential consequences on me, this being the hardest decision of my life, leaving my younger bro in an unknown place. 6/19
He is due to appear in court on the 10th, whilst two solicitors & senior Consular services were present at court, Jagtar was secretly presented and the judge granted a further 4 days remand. Eye witnesses advise Jagtar was carried into court and held up whilst his face was 7/19
covered. #FreeJaggiNow was started in the UK. The @UKinIndia were left red-faced. Jagtar was presented on 14 Nov at which point he told his lawyer he had been subjected to inhumane and third degree torture by @PunjabPoliceInd the courts were advised of this, but ignored. 8/19
To date no independent examination has been carried out. Despite calls from the @REDRESSTrust @IRCT @NilsMelzer @theresa_may @RoryStewartUK @MarkFieldUK @MartinJDocherty @tariqahmadbt @BorisJohnson. In order to silence @FreeJaggiNow an "alleged confession" video was released 9/19
which was made whilst Jagtar was being interrogated, although there was nothing incriminating in the video. His right to a fair trial breached. So far the Indians have breached his Art 3 and 6 of the ECHR and he has yet to be formally charged on the serious allegations 10/19
made against him. The cases were taken from Punjab police by the @NIA_India due to the alleged gravity. Therefore they further interrogated him and tried to make him a state witness or confess to the offences otherwise will be kept in prison for a long time. 11/19
Jagtar has been arrested in 10 cases, one is kept by Punjab Police, one he has been acquitted of as there was no merit to the charges. Eight are with the NIA. Six of them in Delhi and two in Punjab. @NIA_India filed a petition to @indSupremeCourt to transfer Jagtar to Delhi 12/19
Jagtar was transferred to Delhi, Tihar jail in May 2019 and the proceedings have moved at a snails pace. With constant adjournments and the NIA failing to provide the defence with relevant prosecution witness statements. One of the less serious cases is at Trial. 13/19
The investigating officer has confirmed there is no evidence against him, despite this after 46 Trial hearings the case continues. The more serious allegations, to date, 977 days later he is yet to be formally charged on eight of the NIA cases. His right to a family life 14/19
has been breached with the continued detention without being formally charged. The mental torture continues.The Indian Authorities have longed this case out &failed to formally charge him. The UK Government have failed to take the "extreme action" promised by @RoryStewartUK 15/19
@NicolaSturgeon has failed to meet the family or reassure the family she is doing everything she can to ensure the UK government do not fail its British citizen & ensure there is transparency, due process & openness. Despite Jagtar being British/Scottish he has been failed 16/19
by the UK and Scottish government. Jagtar has appeared in 130 Pre-Trial Preliminary Hearings, 175 Hearings in total. This is just a snapshot of what the family have endured over the last 977 days. As a solicitor in Scotland, who has advocated for the Human Rights of over 17/19
100's of clients over the years, I question myself about why my brother's Human rights are being breached & why Human Rights orgs have stayed quiet on his situation. Despite this I will continue to advocate for Jagtar until he is back home in the Scotland. 18/19
It is clear the UK have put trade over Human rights and wish to keep good relations with India however what is not clear, is why this plight has not been covered by UK's mainstream media. The mental torture continues everyday. 19/19
