1. Regarding the #DavidStarkey situation. I'm a little perplexed by the amount of people arguing 'but he's being denied free speech' who are from the UK. To be clear, the UK does not have legally enshrined 'free speech' law, we have legally enshrined freedom of expression. Cont.
2. Freedom of speech falls under this provision. However many people seem to be of the impression on chipping in to the #DavidStarkey situation that this right is unlimited. It is not and never has been. In short, in Human Rights Law, there are two categories of rights. Cont.
3. Express rights (rights that cannot be legally breached under any circumstance), and conditional rights (rights where the right may be breached for a number of legitimate reasons). Freedom of expression is legally a conditional right. It always has been. Cont. #DavidStarkey
4. Examples include under criminal law (Hate crimes including hate speech, inciting others to commit crime etc.), and under civil law (defamation in Scotland or Libel & Slander in England etc.). So those in the UK, please stop weighing in with the... Cont. #DavidStarkey
5. 'free speech' argument, as we don't live in USA and don't have their laws. In the UK, the nature of speech or other forms of expression is that they have always had the potential to have both social AND legal consequences. #DavidStarkey
