Remember #DrBawaGarba? She was a Black junior doctor who took on extra wards in 2011. Little Jack Adcock died. The ultimate mistake was her consultant's. She told him Jack's blood test results. He said she should have 'stressed' them to him. She was put on trial for manslaughter
Dr Bawa Garba volunteered to cover an extra Paediatrics ward at Leicester RI. She'd only just got back from maternity leave and previous to her leave, she had worked in the community. Her consultant was off site because he'd 'double booked'.
Little Jack Adcock had been admitted under the consultant - who was away. There were a catalogue of errors, including results not coming back, computers going down and not enough nurse observations. But the major error was over his blood test results - the high 'lactate' etc.
These tests suggested serious illness. When the consultant finally got to the hosptial at 4.30, Dr Bawa-Garba gave him Jack's blood test results. He WROTE THEM DOWN in his notebook. But did not go to see him. In the evening, Jack collapsed and died.
Dr Bawa Garba said she presumed her consultant would see a child with such problematic results. Consultant, SOR, said she should have 'stressed' them to him. And immediately after Jack's death, he moved to ensure she would be blamed. He refused to let her see the family.
Consultant met with Dr Bawa-Garba and asked her to write down all her 'mistakes'. Doctors in training do this 'reflection' to ensure constant learning. But he took her document - in which she blamed herself, thought was private - and used it in his court evidence against her
At the Manslaughter trial in 2015, Dr Bawa-Garba was found guilty and given a suspended sentence. She was refused leave to appeal. She was struck off in 2018 and appealed. Thousands of junior doctors demonstrated, saying with understaffing, the same could have happened to them.
The British Association of Physicians of Indian Origin argued that more doctors from a BME background are referred/put under disciplinary and are more likely to be prosecuted for gross negligence leading to Manslaughter as Dr Bawa-Garba was.
Dr Bawa-Garba suffered and leaflets were put through doors of parents at her kids's school saying she should be struck off. Before that day of Jack's death, she had a perfect record - this too was bizarrely used against her.
Jack's family were desperate for a trial and admission of guilt for the errors that led to his death. And Dr Bawa-Garba's consultant directed them to blame her, not him. And chronic understaffing in the hospital.
And as a Black headscarf-wearing Doctor, Dr Bawa-Garba was demonised in racist ways. This played into public perceptions of her, the trial and guilt - the role of the consultant, Stephen O'Riordan was barely covered.
It's astonishing that a junior doctor, who had never worked with this consultant, was being attacked for not 'telling' him what to do. Dr Bawa-Garba was clearly a very nice person, volunteering for more work, trying to deal with an absent consultant - what happens? Convicted.
Dr Bawa-Garba had wanted to be a doctor ever since she recovered from Malaria in Nigeria. She came to the UK at 16, took her A levels her and studied at Southampton and Leicester Unis. She was clearly devoted to her work.
Doctors across the country stood up for her declaring 'I am Hadiza' as the same could happen to them, a Professor reviewing failings said that she was 'trapped' by circumstance. But still, she was made the scapegoat for the failures of others - and convicted of manslaughter.
Panorama covered case in detail - but the Consultant (no longer at the hospital) refused to comment. Case of Dr Bawa-Garba epitomises how Black and Asian workers are more likely to be disciplined, even put on trial. They are blamed for mistakes of others. https://www.bbc.co.uk/news/resources/idt-sh/the_struck_off_doctor
Thanks so much for the points from medical professionals that it was more systemic failure than management here - I see your point! Not a doctor but even I could see there were so many things wrong here. I wonder if an appeal would be possible, legally?
Thanks to everyone, & doctors, nurses and med professionals, hearing all your points, and those who point out that it was more systemic failures than consultant oversight. But I think we all agree #DrBawaGarba sd not have been prosecuted for manslaughter. Jack's death was a tragedy.
noting this point from @SamThacker7 about the trial of #DrBawaGarba for manslaughter. 'CPS declined to enter into evidence the Trust's own analysis which was much less critical of #bawagarba and highlighted the many systemic failures.' How was this fair?
