(From Stanford International Student Office)
Trump Immigration EO does *not* impact:
- those who already have a valid H-1B visa stamp in their passport or
- those who are already in the U.S, in H-1B status
- those in the J Research Scholar category (academic PDs)
1 /
- F-1 students on or applying for OPT or STEM OPT
- J-1 students on or applying for Academic Training
2/
There are also exemptions for those whose entry would be in the interest of the US, including researchers or medical professionals who “are involved with the provision of medical care to individuals who have contracted COVID-19 and are currently hospitalized; " 3/
" those involved with the provision of medical research at United States facilities to help the United States combat COVID-19.” 4/
The order does *not* impose new restrictions on individuals already present in the US. If u r seeking to change status within the U.S. to H-1B ( F-1 to H-1B, or J-1 to H-1B) or r porting (transferring) from one H-1B sponsor to another, you will not be impacted by this order 5/
(My comment): This does not make the EO any better. But at the very least it will not affect most academic student and PDs hires for now. It does affect PDs/staff scientists who don't work on medical research and wud need an H1B. Also massively disrupts industry hires. 6/
The EO has lots of vague language that can easily allow them to expand scope. So this could get much worse soon. 7/
