Just saw a poll that says Kamala Harris is favored as VP by 54%. Did we just forget her direct contribution to a system allowing police to abuse and kill black people? Or have we all just decided to overlook it because we saw her march in a few protests?
What makes anyone think a person who dubbed herself “California’s top cop” will continue to do anything but insulate other cops from responsibility so they can continue to brutalize and murder black people?
What did Harris’ office do when an incarcerated man sufficiently proved his innocence to a judge, an appeals court, and the innocence project? Try to block his release on PROCEDURAL GROUNDS.
Harris’s office didn’t merely fight to keep a man in prison after he’d demonstrated his innocence. After losing, Harris fought to keep the newly released man from being compensated for the decade that he spent wrongfully imprisoned.
The going rate was $140 a day for every day of wrongful incarceration but AG’s recommendation is required to receive payment. Harris opposed compensation to the man for over a decade of wrongful incarceration that resulted because of her office in the first place.
Now let’s talk about how she and her office failed to disclose to defense after discovering police department misconduct after technicians was caught mishandling evidence calling into question the reliability of testimony in hundreds of drug cases.
And also failed to implement any sort of written guidelines for ensuring defendants were informed of potentially tainted evidence and testimony that could lead to wrongful convictions.
Then when she was caught and admonished by a judge, she blamed her STAFF for not telling her about the issue for months. She was notified by her staff months before about the increasing unreliability of the technician months before the tech was caught and ignored it.
Then she pointed fingers at the police department for not telling defendants about the tainted evidence... to which a judge said, “it is the district attorney's affirmative obligation to make sure all of that information constitutionally required is provided to the defense.”
Despite her aides urging her to adopt a policy of disclosing police misconduct to defense attorneys to safeguard the right to a fair trial YEARS EARLIER, Harris refused because police unions and police departments were against it.
Had she chosen otherwise, she would not have woken up to this San Francisco Chronicle story: “Kamala Harris’ office violated defendants’ rights by hiding damaging information about a police drug lab technician and was indifferent to demands that it account for its failings,
a judge declared Thursday … In a scathing ruling, the judge concluded that prosecutors had failed to fulfill their constitutional duty to tell defense attorneys about problems surrounding Tainted evidence.”
And there’s so much more. I cannot trust that she will be the V.P. we need when she wasn’t the DA or AG anyone needed.
