2. Take this to the bank. If EPA has received that many SRE petitions then the deal is already done. Refiners have clearly been given the green light for receiving "gap" SREs from the EPA, no matter what Wheeler says in public.
3. Folks, we have now descended into farce on the RFS. Petitions now for "gap" SREs as far back as 2011? Give me a break. The refiners/EPA don't even care about the appearance of trying to implement the RFS according to Congressional intent.
4. Awarding "gap" SREs is such a gigantic contradiction of Congressional intent on the RFS I really am a loss for words to describe just how ludicrous it is. I think refiners and their lobbyists in the EPA know this is a loser in court but obviously don't care.
5. Plus I want to know how the new "gap" SRE petitions handle the 10th Circuit order that petitioners must address passthrough of RIN costs. Bet they don't because they can't admit the truth, which is that in the vast majority of cases RIN costs are passed on by refiners.
