Decision is judicially reviewable (appealable) on the basis of failure to follow procedures, considering irrelevant information and applying the incorrect test. Amongst other grounds. In fairness to Telegraph. They are relying on 1991 case which set out FA and governing bodies are not judicially reviewable. Since the 1993 case of Aga Khan and others in 2005 the scope has gradually been widened.
It’s just not right to say conclusively “it isnt appealable”. This evening is the first time I’ve looked at it in detail and it’s full of complications. It isn’t even as straight forward as I initially thought because of the case law and the guidance on Sports bodies.
What may be more likely is that PIF / AS / Reuben Bros go down the route followed by Hearts & Partick Thistle in Scotland who have laid a petition against the SPL. As has been pointed out there is an internal appeal process.
Given things pointed out it seemed right to summarise the above in light of earlier tweet. If PL fail PIF then the battle is far from over.
