[ No Means No ! ]
📌 The Rape Thread:
🚨Lessons & Warnings 🚨
My intent of this thread is to support Women who have been victims of Rape and/or Sexual Assault.
-
I have chosen to used an Authentic Hadith as the foundation of this thread.
-
Despite this, all Women (regardless of religion) have my support.
It is a sad reality that some of our Leaders remain silent on matters that aren't "religious" ; so I chose to address this from a theological standpoint which is coupled with empathy, support and my basic humanity.
I would be remiss if I didn't acknowledge that I have a Beloved Mother, 8 Sisters and 3 Daughters.
-
So I am a Son, Brother and Father.
-
Each of these realities compels me to use my voice of support and to educate.
The Hadith is both in Arabic & English .
-
Authenticity & References:
Sahih, Tirmidhi (Aka Abu 'Eesa)

[Lesson 1]
•Anonymity

The Woman in this Hadith name is never mentioned. This should teach us that rape victims are embarrassed to even have their names attached to such a filfthy crime. So understand it is extremely difficult to share their experience.
[Lesson 2]
•Prayer

The Masajid doesn't necessarily protect Woman from predators. In fact, many "men" use religious spaces as hunting grounds for their prey.
[Lesson 3]
•Silence

The Woman repeatedly screamed she had been raped.
This would indicate she was initially ignored.

Many rape victims are silenced because their cries fall on deaf ears. This is why we've witnessed many "men" on social media not believing and needing "proof"
[Lesson 4]
•Trauma

The Woman mistakenly pointed out the wrong man. This is because when you are in a state of trauma your judgement is distorted. Notice, Nabiﷺ never called her a "liar" ; as Nabiﷺ understood the psychological trauma better than any of us.
[Lesson 5]
•Helpful Stranger

The people who ultimately listened and assisted the Woman ; were travelers. Often Woman who are raped find the greatest support from strangers or people not from their culture, tribe or community.

Because culture is about pride not the truth!
[Lesson 6]
•Mercy

Subahan'Allah! How amazing is Nabiﷺ !

There is nothing more tragic than being accused of something you didn't do. The man wrongfully accused was given sweet words to uplift his spirits.
[Lesson 7]
•Support

Nabiﷺ didn't want her to remain in same room as attacker, there's healing in detaching from source of trauma. Nabiﷺ said she's forgiven for sins. Not because she's sinful, but to keep her connected to Allah, because most rape victims have suicidal thoughts
[Warning 1]
•Hadith Placement
-
Let us first look at where the Hadith is placed, it is in:
كتاب الحدود
The Book Of Legal Punishments
-
This is warning us that rape is not something to be taken lightly or to make jokes of.
[ Warning 2 ]
•Truth

Nabiﷺ never doubted she was being truthful, nor asked for "proof."
-
In Al Islam we assume the truth until proven lie In this era, we are assuming something is a lie until proven a truth!
[ Warning 3 ]
•Punishment

The justice that we must seek is a punishment for rapist.

It appears Women are being victims of rape and equally victims of chastisement from the very community that quotes Qu'ran and Ahadith!

For this reason, many have lost hope in religiousity
[Warning 4]
•Scholarly Opinion

Imam Malik said:

والعقوبة في ذلك على المغتصب. ولا عقوبة على المغتصبة في ذلك كله.
The legal punishment is applied to the rapist and there is no punishment for the Woman who was raped in any case.

Muwatta
Book 36, Hadith 1418
