So what happened on friday is this: the judge denied #jamesdailey a new trial because there is supposedly no new evidence for his innocence. In the hearing a signed declaration was shown from #jackpearcy the man who did murder the girl. He refused to repeat it at trial. 1/14
In the original trial Pearcy didn& #39;t testify against Jim. He has never spoken in court about whether Jim was involved. Yet the statements outside court are apparently seen as the truth and the many, many times he insisted he alone was responsible are & #39;no new evidence& #39;. 2/14
So what about other evidence? Well, there is none. That is one of the things that makes it so, so hard to prove he is innocence without a doubt ( that is what is asked of him. No reasonable doubt in postconviction appeals in Florida). There is no physical evidence. Nothing. 3/14
Jim was convicted, in a 2.5 day trial, because of Pearcy& #39;s story and 3 jailhouse snitches. Two have admitted they made it up a long time ago. The other one was Paul Skalnik. @pamcollof explains here https://nytimes.com/2019/12/04/magazine/jailhouse-informant.html
why">https://nytimes.com/2019/12/0... his story is bullshit. 4/14
Even the courts have dismissed Skalnik as a reliable witness. They admitted in court that due to the lay out of the jail Skalnik could never have heard Jim confess the way Skalnik claimed. Also the jury was told Skalnik was an good man who never had been violent. 5/14
All the while prosecution knew Skalnik had been arrested for molesting a young girl. James Dailey had never been accused of such thing. He never had been in jail before being arrested for this. He didn& #39;t know he could not trust his state appointed attorney 6/14
who had not interviewed one witness before the trial. There were people who had seen Pearcy and the girl alone shortly before the murder without Dailey. The jurors never heard them although they had talked to the police. 7/14
What did his attorney do? Apparently he slept with the prosecutor. They got married not long after the trial. James Dailey trusted the justice system. It has failed him for 35 years and now it might kill him 8/14
He has lived his life in 6 by 9 cell for almost 33 years now but he managed to make it worthwhile still. He has many friends on the row and in, what he calls, ‘the real world’. I am so proud to have beeen one of them for the last 22 years and I learned so much from this man. 9/14
But it’s not just me. There are his Air Force friends, his high school friends. He is very, very proud to have not lost anyone over being in prison for this for so long. "Why can& #39;t the courts see what everybody who has ever met me can see?" 10/14
The answer probably is: They see, they just don& #39;t care. This case highlights so many things that are wrong with the justice system in Florida. They think if they kill him, they can bury this story. They can’t. I might not have much trust in the American justice system but 11/14
I have faith in the American press. They will tell Jims story and they will warn America. The judge might have tried to bury this ruling in the burning of Minneapolis but
@TimesDan caught it. I trust @pamelacolloff with Jims story and @mattgutmanABC has things to show you 12/14
I had to redo this thread due to too many mistakes. I am hurting right now. It is the most horrible feeling in the world to see one of your best friends being murdered in front of you and not be able to do a damn thing about it. But I can tell you his story and I will 13/14
Also lets dust of this petition. I want De Santis to know we are watching him. Actively killing an very likely innocent man (i am a 1000 procent sure but I know Jim) might not be the smartest thing to do if you have political ambitions! 14/14 https://actionnetwork.org/petitions/james-m-dailey-is-innocent-stop-the-execution">https://actionnetwork.org/petitions...
