If you get arrested, PLEASE DO NOT SAY ANYTHING ELSE BUT "I'm invoking my rights to remain silent and I'm invoking my rights to have an attorney" THIS WILL INVOKE YOUR RIGHT TO COUNSEL. ANY OTHER PHRASE WON'T INVOKE YOUR RIGHTS.
If you need more info then this is the thread I found on tumblr. I'm not a law student, so if there is anything wrong here please correct me!
"Law enforcement will intentionally misinterpret every type of statement asking for lawyer as not asking for lawyer"... "You can't just tell them you won't talk without a lawyer present or that you want a lawyer. You have to state that you are invoking your rights"
What phrases DO NOT invoke your rights:
Ask "Am I free to leave?" Because "by forcing them to admit that you are not free to leave, you are creating a record which your attorney can use to prove you were in custody"
You HAVE to say "I'm invoking my right to remain silent" because by remaining silent WON'T invoke your right to remain silent.
Say,"I'm invoking my right to an attorney" THEN SAY NOTHING ELSE.
DO NOT MAKE ANY CASUAL CONVERSATION WITH THEM
Imma just add this here
