Most groups in this article requesting waivers in "Maintenance of Effort" requirements under IDEA have been virulent hostile to this federal law prior to our pandemic. They already enjoy a de facto plutocracy in the outcomes of IDEA due process challenges. https://twitter.com/TraciLambert14/status/1266476392318996480
They effectively blacklist advocates deemed too effective. One group, the #AASA, overtly & systematically censor parents on social media for intelligently articulating opposing views to policies their lobbyist's disseminate for grassroots support.
The marketing of one organization seeking "limited waivers of IDEA" was so brilliantly deceptive, depicting smiling children on a bright sunny day, in a playground, all standing wearing backpacks with little brown lunch bags in their hands.
Past horror stories from parents would be surreal had they not been factually corroborated with experiences of other parents & advocacy groups across the country & partly documented with the @NatCounDis .
When @BetsyDeVosED refused waivers of IDEA which the congressional elite sought for its contributors under CARES, that only galvanized the establishment to ignore federal law. We've seen contemptuous bullying tactics of school districts forcing parents to...
sign waivers before remote services were provided for their disabled child, Union officials pre-empting message of refusing to return to work, which I agree, without proper planning and supplies in place.
And now, lawsuits from various entities within the school cabal, looking for one sympathetic jurist to favor any one element of their past, litigation efforts at treating IDEA and FAPE a mere de diminis.
Schools have made no provisions under IDEA & FAPE to provide disabled students who cannot tolerate remote services, hands-on intervention alternatives. The decision to close summer schools for disabled students that usually obtain a 12 month program....
was made with no alternate plan despite specific & intimate knowledge of the medical and therapeutic necessity of each child & the potential of irreparable harm & irreversible global regression. Spec Ed Depts., are even refusing requests for RSA's which.....
allow parents to seek outside vendors to temporarily get services desperately needed for their children. Since these service providers are already deemed "essential" & doing in-house & facility therapies, why not minimally support these students?
Why should we waive "Maintenance of Effort" criteria to entities that have made no effort nor maintenance in regards to the student population above? Why reward this cabal for its purposeful inaction knowingly placing disabled children in danger?
They've proven their contempt for federal law & it's preposterous they ask for waivers while actively continuing to breach IDEA & FAPE.
Thankfully, there are great teachers, therapists & administrators in this system. I've seen them in action & have the utmost admiration for the challenges they face & tremendous dedication and efforts they make with our children.
Unfortunately, the system is hostage to a well-funded plutocratic group & pocket politicians. They control the policy & due process mechanisms that routinely dispense inequities to disabled children.
