Under S 258 of the Criminal Code Law of Lagos, rape is unlawful sex with a woman or girl, without her CONSENT and repeats same thing in the Criminal Code Act.
Same definition applies in S 282 of the Penal Code.

Rape is complete upon penetration.
Under the three laws, only a WOMAN can be raped. Actually, Nigerian Law is silent on whether a woman can WITHDRAW her consent during sex, which will then turn sex into rape. However, Sections 75-76 of the Sexual Offences Act, 2003 (a UK Law) allows withdrawal of consent.
UK Law is of persuasive authority. This same position is applicable in the U.S as held in People v. John Z by the Supreme Court of California. These are not Nigerian Law positions and I'm unsure that Nigerian courts have made pronouncements on this. Lawyers, help me out on this.
The literal interpretation of Consent means that it can be given and withdrawn, hence, given these strings, it is arguable, though jurisprudentially noted that withdrawal of consent will or will not be rape.
A sharp distinction from the general position on rape in Nigeria is the Violence Against Persons (Prohibition) Act, 2015 which defines rape as the penetration of the vagina, anus or mouth of another person with any other part of a person's body. Hence, anybody can be raped under
The VAPPA, 2015 but VAPPA is only applicable in Abuja. Hence, a MAN can be RAPED in Abuja but in every other place in Nigeria, ONLY A WOMAN can be raped.

S 6 of the CCA and S.258 (3) of the CCL says sex between married people is not UNLAWFUL.
Hence, a MAN cannot rape his WIFE under Nigerian Law.

What is rape then?:
1. Sex without consent between a man and a woman
2. Sex with forced or fraudulently obtained consent
3. Sex while impersonating a woman's husband
4. Sex when you told the woman you were going to do something else. E.g. a doctor penetrating his patient during medical examination.

What is not rape?

1. I didn't like the sex
2. I felt sore
3. The sex was rough
4. Sex between husband and wife
5. Forced sex on a man by a woman
6. Every other act without PENETRATION but the presence of ingredients of rape is attempted rape (S359 CCA)

7. Groping boobs, ass or any other part of the body is not rape, at best, it is indecent assault on females (S 360 CCA)
What should you do if you think you've been raped?

1. Do not have a bathe
2. Go to the Police station to file a complaint
3. Go to the hospital for medical exam ( I suggest you switch this to 2 because of bad behaviour by police officers)
4. Keep every form of evidence
E.g torn clothes, panties worn during the "rape".
5. Do not fear the stigmatization. Speak up, speak out immediately.

What to do when you think you've been unfairly accused of rape?
1. Talk to your family and friends
2. Do not apologise for what you did not do.
3. Contact your lawyer
4. Do not be forced or coerced to make an incriminating confession at the Police station
5. Do not for the sake of "peace" apologise or admit on social media. Stand by your truth.
6. If the case gets to court, defend yourself.
Rape is bad, leaves a sour taste in everyone's mouth. If you are so horny and cannot hold yourself, jerk off. Better to jerk off than rape, biko.

Under the CCA and CCL, rape is punishable by life imprisonment. 14 years for attempted rape.
Suggested improvements for Nigerian rape Law?

1. Recognise that a man can be raped
2. Recognise marital rape
3. Reduce the standard of proof for rape
4. Criminalize false rape accusations.
