I think the reasoning behind the third degree murder charge is that first degree requires intent and premeditation, second requires intent, and third will be an easier conviction considering the burden of proof is “beyond a reasonable doubt” which is VERY strict. a manslaughter charge will add time to the sentence and be easier to prove because the standard for voluntary manslaughter generally has to do with a “heat of the moment” intention to kill. I think this is the best way to make sure there IS a conviction and he doesn’t walk free.
All in all I think this is a good thing. Do I think there was intent to kill? Probably. Would the prosecution be able to convince a jury beyond a reasonable doubt that there was? Maybe not. They are gonna fight this hard as hell and appeal everything. This is smart (IMO)
