I think the fact that @realDonaldTrump and @curaffairs are simultaneously arguing that social media shouldn& #39;t be allowed to self-moderate because that& #39;s a violation of "free speech," from two very different directions, says something about the danger of that idea.
@Popehat laid out the argument for why it is not at all a violation of our First Amendment rights for social media companies to self-moderate here: https://legaltalknetwork.com/podcasts/make-no-law/2019/08/deplatformed-social-media-censorship-and-the-first-amendment/">https://legaltalknetwork.com/podcasts/...
Just speaking selfishly as a social media user, I definitely don& #39;t want sites to be forced not to moderate. I& #39;ve been chased off forums that filled up with trolls because of a lack of moderation. If you think Twitter or FB are cesspools now, just wait until nobody can be banned!
I& #39;ve been called a stupid cunt on FB by Bernie Bros and Trumpalos. The First Amendment does not protect their right to do that, and FB has an interest in not letting them do that because it could chase me off the platform. Now, whether it acts in that interest is another story...
This piece by @M_feeney lays out pretty clearly why the "platform/publisher" argument is a red herring and addresses other misrepresentations of section 230 of the Communications Decency Act. https://www.cato.org/blog/newspapers-are-spreading-section-230-misinformation?fbclid=IwAR21ccyRLBG31D8I5CnzLYMhOKWaBnIx7dbPj0T3jhH0UjKRgDMPMPptCKw">https://www.cato.org/blog/news...
