The Constitution of India was written by a Constituent Assembly. How was this Constituent Assembly appointed? By nomination and election of jurists/intellectuals by members of Provincial Assemblies in British India. This was an indirect selection, to start with. The Provincial /1
Assemblies had no representation from the population of Princely States, which eventually formed 30% of the population of the Republic of India.
Next, the only members of the Constituent Assembly were primarily nominated from Provincial Assemblies in India, which means that it /2
was predominantly Congress that got to select who wrote the Constitution. A list of members would show how many were already officially Congress members or later assumed offices of high office with Congress support.
When they made laws governing the functioning of Hindu /3
religious institutions and the Hindu Personal Law Code, were the traditional scholars or religious leaders even consulted?
Almost to a man, and they were predominantly upper-caste men, they were educated in the English model of education and were often part of the /4
colonial governance and judicial models. Is it any surprise, then, that the Constitution reflects the Protestant values that informed the colonial institutions and education? Until the 60s, Intermediate subjects used to include British history.
Next, the secular, socialist /5
values of the Constitution, which is today an article of holy faith, is actually inserted into the Preamble by the 42nd Amendment, passed during the Emergency, when most of the Opposition was jailed.
Hindus are living under a regime that largely continues the colonial /6
system.
How much of the governance practices of the princely States such as Travancore or Mysore or Baroda was even taken into account. Instead, the laws and practices in force in Bombay, Madras or Bengal Presidencies were applied in toto /7
So, don't let anyone throw the Constitution at you. It does not reflect the will of the great mass of Hindus.
You are obliged to respect and follow it only because the Republic of India will fall into anarchy and chaos if you throw out all rules. So, Constitutional change /8
by Constitutional means with the consensus of the mass is the road to our liberty.
Don't forget that. That's our goal /END
