…the Navajo County Court signed a new warrant for Neko’s arrest based on that 18 year-old marijuana charge. Right now, he is being held illegally because they violated his due process rights.
Nevertheless, the judge said he doesn’t have jurisdiction to set bail because we appealed his decision all the way up to the Arizona Supreme Court.
Neko is caged in a 4x12 cell w/another bunkee. It’s not possible to practice social distancing in the cage.

He does not have a mask, gloves or hand sanitizer. Arizona will not tell Neko or anyone in jail whether folks have COVID.

Before covid-19 there were 3 people in that cell 15 hours a day. They’re now starting to put the 3rd person back in because Arizona is going back to business as usual.

Neko says new inmates arrive hourly. While I was on the phone with him today there was a new arrival. Neko said that person would have to sleep on the floor in a cell because there were no bunks for him.

Lance is currently in custody on drug charges. He has asthma, hypertension & Covid-19. He& #39;s in a prison called Terminal Island in SoCal. This prison has more people diagnosed with Covid-19 than all of the state prisons in California combined.
They haven’t taken Lance’s temperature since May 8th. There is no treatment going on for any inmates.
All the folks with COVID-19 are lumped together and left to die.

The last time Lance was given a mask was two weeks ago. For a two week period they didn’t have hot water. For almost a whole month there was no access to phone calls. Lance was not able to contact me or anyone else to let us know what was happening behind prison walls.
The way I found out Lance had COVID-19 was through a letter he sent me. After receiving that letter I did not know if Lance was dead or alive.
People all around Lance are sick, coughing and not well. Lance told me: “They are begging for help and no one is listening.”

A lawmaker visited the prison last week & said she could hear inmates& #39; death screams and pleas for help.
Lance is a non violent offender. Probation only wanted 48 months. The judge allowed Lance to go to a program. The program alleged Lance had a cell phone and kicked him out.

The judge said he did not want to hear any excuses and despite a cell phone never being found in Lance’s possession, Lance was sentenced to 96 months.
Essentially receiving an additional 48 months for a cell phone.

Under the CARES Act, because of his underlying condition & because he is a non violent offender Lance can be released to the safety of his family.

Today @ACLU sued on behalf of inmates at Lompoc and Terminal Island federal prison, accusing the Bureau of Prisons of “deliberate indifference” for not releasing non-violent criminals.

This lawsuit states the government is violating the plaintiffs 8th amendment rights against “cruel and unusual punishment,” through a series of “unconscionable delays, blunders and failures to follow officials& #39; guideline”.
