In the Wisconsin Supreme Court case striking down the stay-at-home order, Justice Rebecca Bradley (one of the conservative Justices in the majority) concurs and makes an extended comparison to Korematsu, the WWII Japanese internment case.
She claims that she is mentioning Korematsu “in order to remind the state that urging courts to approve the exercise of extraordinary power during times of emergency may lead to extraordinary abuses of its citizens.” https://wicourts.gov/sc/opinion/DisplayDocument.pdf?content=pdf&seqNo=260868
Obviously there are literally no other cases that could possibly accomplish this objective.
One might argue that there are key differences between the “extraordinary abuse” of rounding up people of Japanese descent due to unfounded racism and the “extraordinary abuse” of telling people to stay homes due to a deadly virus supported by mountains of scientific evidence.
jfc she has a 3 page footnote quoting her own comments at oral argument and *underlining the key passages for the reader*.

It’s almost like she’s feeling a little “fragile” about her comments being described as racist.
