Today the @spfl members voted against having an independent investigation into the recent events around the vote to end the Scottish football season. Immediately in the media claims that the season could be called by the discretion of the SPFL board were circulated
in the media & among the Celtic support. Gerry Moynihan QC advising the SPFL made very clear that according to their rules & articles they could not call a league in any division as it stood. This was circulated to all members of the SPFL under the heading briefing paper,
What was clear was @spfl couldn't call a league without 38 games. What was needed was a resolution that gave them the power (they believe) to have the ability to do this. Gerry Moynihan in the briefing paper to the SPFL board advised them again how to circumvent the problem
As you read above what GM QC advised what was required was a ''democratic mandate'' or a ''resolution'' though he does caution ultimately it may be challenged & that although there is some comfort for the SPFL the ultimate descion would be the courts should a mem club pursue
Now you see the SPFL needed a way out of log jam & under the guise of needing to declare league positions to pay clubs their fee payments they claimed that the only option to do this was by having the league positions declared & free to distribute the remaining prize pot
The SPFL board to distribute in this matter had to change it's own rules & articles which was clearly expanded by Rangers counsel in their advice to the club. Strange thing is that to distribute as at it was the SPFL needed no resolution or change to it's rules & could have paid
So to blackmail the clubs into accepting their way the SPFL had to propose a change of it's articles & rules while a route to pay the clubs existed as also demonstrated in the case of Gretna who were paid in 2008 money against future payments due from the Scottish football body
Now in all this madness to declare titles the SPFL omitted to tell their own members of the dangers pertaining paying the remainder of the prize fund. Moynihan advised the SPFL that the date for a refund to broadcasters was the 13th March. He made it clear that payments from that
date could ultimately have to be repaid back. He also in his advice made it clear that the SPFL were ON NOTICE for a claim of refund & that. Doncaster at this same stage was advising the members quite differently. He said only at risk if they failed to declare league positions
Amazingly on the 17th April Doncaster began to distribute money among the lower leagues despite not only on notice of the potential for refund but that BT had formally alluded they intended to do so! This obviously out the SPFL on notice to prepare to repay the money advanced
& to be advanced to the SPFL from next seasons broadcast income! Broadcast money seriously at risk at present if football is unable to start by August the 1st.

All this change of articles & rules & every decent procedure discarded to give Celtic a title.......
