I have long supported Congress& #39; right to tax and other records from Pres. Trump. I also believe the House abused this power with overbroad demands. Today, Justice Breyer expressed the same concern over "pretty vague" House demands and worried it may empower the next Joe McCarthy.
Despite my support, I previously warned that Congress was moving forward with dangerously overbroad demands and risking a bad case making bad law. Today& #39;s argument showed justices looking for a compromise--reflecting unease over the scope of the demand. https://jonathanturley.org/2019/04/04/congress-moves-to-grab-trump-tax-records-from-last-six-years/">https://jonathanturley.org/2019/04/0...
...As one who favors congressional powers, this case could have been greatly strengthened with a more limited, tailored demand to avoid sticker shock on the Court. The law still favors Congress but this is an example of a political rather than legal strategy shaping litigation.
