On the background of the practice of #Rotation in #Egypt or التدوير. I asked myself, what if we eliminated the whole public prosecution sector from the justice equation? In this thread, I will answer this question while trying to look at the bigger picture:
1-Journalists Mostafa El Aasar and Moataz Wadnan were finally released after spending more than 2 years in pretrial detention to find themselves facing new charges on a new case that allows the prosecution to order their detention AGAIN!
2- As we have been witnessing this practice in most cases now, what is the prosecution role here? A) public prosecutor orders the arrest based on initial investigations made by national security police and then take up investigations that mostly does not end before 2 years
3-B) After 2 years of pretrial detention–may be more- the same prosecution issues a release order, then the prison administration sends the detainee to their district police station where they should be released. There, the police station refuses to release the detainee until ..
4-they get national security police approval. C) That’s the moment where we see that national security police authority transcends the prosecution decisions and freeze its effects. after days, maybe months they the detainee goes back to the same prosecution to be interrogated..
5-in a new case facing new charges. It's clearly obvious that the final word in due process and in investigating state security-related cases is up to the state security police, there are no serious investigations made by the prosecution.
6- just to keep individuals in prison for as long as possible, Rotation is a newly created way to slowly kill detainees physically and Morally.Led and executed by state security police while the prosecution only role is to cover and facilitate this crime and breach to due process
