I have a proposal for fixing our overworked federal judiciary. Obviously, this is something for the new administration to handle, but the Supreme Court has reported every year that the federal system needs more judges. I agree, as a federal court litigator.
As soon as Democrats take back the Senate and White House, we should pass legislation doubling the number of trial and appellate judges in each Circuit, assigning the trial judges based on the case load in each District, and end the practice of using trial judges hearing appeals.
We should also pass Senate Rules setting out detailed objective qualifications for all federal judges and justices, with any judge meeting or exceeding the minimum qualifications to be subject to approval by a bare majority and any who does not meet them to need a 2/3 majority
Congress should also pass strict ethics rules for the Supreme Court, covering financial interests in pending cases; ex parte contact with counsel, parties, or party representatives, and a means by which the a justice may be disqualified from a particular case.
Finally, to ease the work load and make it feasible for the Court to implement strict conflict of interest rules, the Supreme Court should be increased from 9 to 15 Justices, with the new positions subject to nomination and approval under regular order.
