The second alert was the oversimplification of the standard of review. The third was the treatment of the judge-jury relationship in this interesting context.
Also noteworthy (and addressed in briefing): Should the Texas Supreme Court spend one of its limited grants opining about a case governed by New York law. Yes.
To be clear, I& #39;m not implying the court cared what I wrote. I& #39;m happy the court saw and resolved the concerns for whatever reasons. I& #39;ll stop now because already I& #39;ve wasted far too much of the time that I had allocated to wasting time elsewhere.
