1. TENDER DOCUMENT

So apa itu Tender Document?

Tender Document ialah satu sistem untuk pilih contractor untuk jalankan sesuatu projek. Procedure sesebuah tender tu bergantung kepada aspek-aspek ni:
1. Type of tender
2. No. of tenderer
3. Type of contract
4. Tender price

6. Location
7. Selection mechanism (time/cost/quality)

Tender document ni dia memberi peluang kepada contractor untuk mengharga dan membida mengikut kerja-kerja yang diperlukan untuk projek tu. Once dia dah bid and accepted, a binding contract akan formed.

So sebagai seorang QS, korang kena ada kefahaman yang sangat JELAS. Tak boleh kabur-kabur dalam isu tendering sebab ini ada basic bagi you guys.

Tujuan tender process dibuat adalah supaya pengagihan kerja tu jadi lebih adil. Client boleh bandingkan harga-harga dari various contractor.

Tapi korang kena ingat yang harga yang rendah bukanlah faktor untuk menang bid. Ada faktor-faktor lain yang dia tengok juga

So setiap item dalam Tender Document ni perlu difahami oleh tenderer. Walaupun content dia mostly sama je setiap tender, but kadang tu ada special provision yang dia state dalam tu. So always check!

Special Provision tu macam ni:
1. Commencement date and completion date
2. Specific work method
3. Limitation to access to the site, storage material or plant/machinery
4. Use of certain materials and tools

2.1. Open Tender
Type yang ni ada main tendering procedures yang digunakan oleh government and private sector. Client akan iklankan tender offer kat certain medium macam surat khabar, e-perolehan, tenderDB etc. and invite contractor untuk join.

2.2. Selective Tender
Selective Tender ni adalah alternative untuk limitkan kuasa open tender tu. Dia still ada bidding process cuma contractor tu dah shortlisted dah. List tu mungkin dari client's professional adviser, past project etc.

2.3. Two-Stage Selective Tender
Yang ni combination of competition and negotiation.

Contractor will be selected competitively pada early stage.

Lepas tu ada negotiation process.

2.4. Negotiation Tender
Negotiation Tender ni selalunya membabitkan 1 hingga 3 contractor je. Client akan pilih contractor mana yang dia nak nego. Lepastu contractor tu akan diberitahu apa workscope yang dia perlu buat.

Ada juga certain client ni dia siap buat proper tender document and ada BQ untuk assist contractor untuk bagi harga untuk di-nego.

Negotiation boleh di-applied dekat contract seperti berikut:
1. Partnering type of contract di mana dia nak buat win-win situation.

2. Client pernah ada long-term business relationship dengan contractor
3. In situations bila client and contractor tu ada subsidiary dalam company tu.
4. Contractor tu involved untuk financing the project.

5. Bila client nak contractor yang sama untuk teruskan project yang sedia ada. Mungkin nak buat fasa kedua ke macam tu.
6. Bila client nak start project cepat dan nak buat fast-track basis.
7. Security reason.
8. Emergency project

9. Bila cuma ada satu contractor sahaja yang boleh buat project tu sebab dia je yang specialist dalam bidang tu.

2.5. Term Tender
Term Tender ni biasa guna untuk maintenance project. Dia award contractor untuk cover certain project. Term Tender ni ada timescale yang fixed.

Client akan sediakan rate of work dan contractor hanya perlu letak percentage untuk deduct and adding the rate je.
