DJs and some others have been having issues with #livestream of songs on social media. The #lockdown and #stayathome has affected everyone and the music industry has basically turned online. People are loving it and being entertained but right owners are seeing a competition #1 https://twitter.com/djjazzyjeff215/status/1252044741966991362
#2. They've been reporting the use of their music and copyright works to the ISPs (basically in this case the SM platforms used to air the stream)and their music is being removed or taken down. The platforms have to do that anyway (after following some procedure) otherwise they
#3 can be liable too for copyright infringement. So basically, this is them trying to save their necks. There's the aspect of copyright that tries to preserve the right of the public to information. Exceptions to copyright basically chief of which is fair dealing or fair use.p
#4 Fair dealing allows the use of copyright works for research, review ,criticism, private use and reporting of current events but the author must be acknowledged in public. Although DJs doing #livestreams are doing so free, their use of those songs isn't for any of these
#5.specified purposes even if they acknowledge the authors of the songs. Another exception is use for parody, pastiche, caricature. These are not what a DJ http://does.So  its doubtful the actions of these DJs fall into this category really. Some factors that guide the court
#6 in determining fair dealing for instance include whether the use of the work is in commercial competition with the owner's exploitation of the copyright work. So what will be the effect of the use of the music by the DJs on the potential market or value of the copyright work?
#7 on the one Hand we can argue that these #livestreams increase the popularity of the music and will make listeners will want the music more, the artiste becomes more popular etc. But on the other hand, listeners may as well just listen freely and use the DJs mix and not bother
#8 to pay for the http://music.no  more aid services like Spotify and all. Consequence, artist doesn't get paid, except when they are invited for performances, which not all music artistes can actually charge large sum for. So basically we're seeing another shift in the
#9 music industry, copyright law would have to adapt to this increasing exploitation of protected works and try to balance the interest of the public to access music and be entertained and that of right owners to make money from their works(recoup investments and be rewarded for
#10 Labour). Solution for now is still to use collective management. DJs obtain some kind of blanket license from music CMOs and they get access to use the music while right owners get paid for such use. Let's face it as much as DJs are saying its a free live stream, their own
#11 popularity is also increasing. And post covid, the more they become popular, the more they charge for their services. If they rely so much on the works of others shouldn't they pay for their 'raw materials'? In Nigeria we have to make our CMOs work, otherwise the artistes are
#12 the losers in the long run. DJs could pay through their associations, I believe they have one.doesn't have to be on individual basis.this trend is something to watch out for. what's your take? @esmeraldo99 @ayotula @Thejollofdiary @fozadoza @DesyOsas @chythepenguide
