JUST IN: A federal judge in California has ordered ICE to make "custody determinations" — consider releasing — *all* immigrants over 55, those who are pregnant and detainees who suffer from chronic health conditions, for as long as coronavirus poses a "substantial threat of harm"
The order by U.S. Judge Jesus Bernal certifies a class of ICE detainees with certain "risk factors" that make them more susceptible to severe illness or death if they contract the coronavirus:

"At this stage of the pandemic, the threat is even clearer. The number of immigration detainees testing positive for COVID-19 continues to increase at an alarming rate," Judge Bernal wrote in his order.

Coronavirus cases among ICE detainees surged to 220 today (96 new cases).
Judge Bernal also ordered ICE to define "minimum acceptable detention conditions" for all detainees with the stated risk factors, including those whom the agency says it has to detain because of the mandatory detention provision of the INA (certain criminal convictions).
