A Thread.

When pple say Kenya is still a colony & that many of the state's institutions, esp. the govt., behave pretty much like the British colonialists, this is neither an exaggeration nor merely a political statement by "idle"
critics. It is statement of fact. This thread is an attempt to provide the evidence to prove this.

Acts of Parliament, enacted by the British colonialists (primarily to support better exploitation, dehumanisation & subjugation of the non-white subjects of the Kenya
colony) are, almost 60 years after "independence", still very much part of the #LawsofKenya. Both the Executive & Parliament have considered these laws & decided they are still needed, pretty much for the same reasons that they were passed in the 1st place by the British.
Masinde Muliro's words in the House of Representatives on 01.02.1966 are as relevant now as they were then.
Every Constitution of Kenya since 1963 has always provided for Acts of Parliament, in force immediately before its promulgation, to continue being valid, albeit with the necessary modifications. This was was done Art. 262, CoK, 2010 & Sec. 7 of its Sixth Schedule.
Kenya gained its independent on 12.12.1963, though the British monarch remained as head of state until 11.12.1964, after which it became a Republic. Full text of laws cited here are accesible at #LawsofKenya online database, hosted & maintained by @MyKenyaLaw.
Agriculture Produce (Export) Act. This Act was enacted (passed) in 1921 and commenced (became law) on 1st November 1923. It was last amended (changed) on 24.11.1964, with the changes backdated to 12.12.1963.
Architects and Quantity Surveyors Act. This Act was enacted in 1933 and commenced on 01.04.1934. It was last amended on 01.01.2001.
Armed Forces (Out of Bounds Areas) Act. This Act commenced 20.04.1948. It was last amended on 21.04.1967.
Asian Officers' Family Pensions Act. This Act commenced on 01.05.1942. It was last amended on 04.06.1971.
Asian Widows' and Orphans' Pensions Act, 1927. This Act commenced on 22.10.1927 and received its assent on 15.07.1961(?). It was last amended on 20.04.1967.
Bills of Exchange Act. This Act commenced on 14.05.1927. It was last amended on 13.04.2017.
Birth and Deaths Registration Act. This Act commenced on 09.06.1928. It was last amended on 08.11.2019.
Books and Newspapers Act. This Act was signed into law on 01.07.1960 and commenced on 19.07.1960. It was last amended on 04.06.2002. This Act explicitly acknowledges Kenya is still a Colony.
Borstal Institutions Act. This Act was assented on 22.08.1963 and commenced on 02.09.1963. It was last amended on 07.12.1983.
Branding of Stock Act. This Act commenced on 12.12.1907, making it one of, if not, the oldest Acts of Parliament in Kenya. It was last amended on 26.08.2016.
Bretton Woods Agreement(s?) Act. This Act was enacted on 04.12.1963 & came into effect on 10.12.1963, two days before the country's "independence." It was, in effect the legal instrument by which Kenya became a member of IMF & World Bank. Last (hand-amended) pursuant to LN 2/1964
British Standard Portland Cement Company Limited (Bamburi Factory). This Act was, unusually(?) enacted and commenced on the same date: 29.09.1951. Peculiarly, the Company has statutory immunity for nuisance except on grounds of negligence. Not sure this wld survive challenges
under Articles 42, 69 & 70, CoK, 2010. The Act was last amended on 08.07.1966. This amendment replaced British monarch, her heirs and successors in title, with the Government of Kenya. The transition from white colonialists to their black successors was seamless.
Brokers Act. This Act commenced on 24.12.1930. It was last amended on 30.12.2006.
Building Societies Act. This Act commenced on 06.07.1956. It was last amended on 24.12.2008.
Cabinet Secretary to the Treasury (Incorporation) Act. This Act was enacted on 06.03.1962 & took effect on 13.03.1962. It was amended on 24.07.2012. The Cabinet CS, is, to my knowledge, the only state officer who is also a distinct body corporate. No idea why or implications.
Carriage of Goods by Sea. This Act came into force on 26.09.1926. It was last amended on 26.06.1968
Cattle Cleansing Act. This Act commenced on 27.04.1937. It was last changed in 1979 (date of the change not readily available.)
Chiefs' Act. This Act commenced on 24.03.1937. It was last amended on 13.04.2017. An odious piece of legislation that keeps & maintains the colonial, oppressive infrastructure of the state.
