The court found that that when Sinclair posted her image on Instagram, she agreed to Instagram’s terms and conditions which authorized Instagram to grant a sublicense to anyone who uses Instagram’s Application Programing Interface (API) to embed public posts. /2
The court then found that when @mashable embedded the Instagram post in a web article, it was entitled to do so based on its sublicense from Instagram that permits such a use. Setting your Instagram account to “private account” prevents embedding. /3
So, we’re urging everyone to read this and please stand united with us in changing your @instagram account to PRIVATE and letting people know why by editing your profile to say so. private. https://nppa.org/news/instagram-terms-service-what-you-should-know-and-do /4
